New Fair Work Information Statement

The Fair Work Ombudsman has recently updated the Fair Work Information Statement (FWIS). All employers should ensure they are now using the new version of the FWIS.

Remember that the FWIS must be given to all new employees before or as soon as practical after the employee starts employment. This can be done by giving new employees a copy of the FWIS in person, by email, mail or by giving them a link to the Fair Work Ombudsman's website at: https://www.fairwork.gov.au/employee-entitlements/national-employment-standards/fair-work-information-statement.

The easiest way to get the FWIS to new employees is to include it in the offer documents or starter pack you send out and have the employee acknowledge receipt in writing.

The FWIS is a key step for all employers to take to ensure Fair Work compliance, as section 125 of the Fair Work Act 2009 (Cth) (FW Act) provides that employers who do not give each employee a copy of the FWIS will be breach of the National Employment Standards in the FW Act, which may result in a financial penalty being imposed.
